By accessing the website at www.HatDistrict.co.uk, you are agreeing to be bound by these Terms and Conditions, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you must not use or access this site. The materials contained in this website are protected by applicable copyright and trademark laws.

You agree that the material accessed through the use of the web pages on our website is obtained entirely at your own risk and that you will be entirely responsible for any resulting damage to software or computer systems and/or any resulting loss of data even if we have been advised of the possibility of any such damage.

If you are looking to work with any creatives to engage children and or vulnerable adults, it is your responsibility to check the guidance on the Government Website https://www.gov.uk/find-out-dbs-check to see whether a Disclosure and Barring Service check is required. Many creatives who regularly work with communities and in schools will already be registered with the annual DBS updates service. The Culture Trust does not conduct DBS checks on the creatives listed on the Directory.

We do not accept any liability in connection with any third party websites which may be linked or accessible through our own website and we do not endorse or approve the contents of any such site.

1. Eligibility

Publication of your profile on the Directory is subject to successful submission of required details as well as review and acceptance by the Culture Trust. To be eligible to sign up for the Directory, you must be residing or working in Luton. You must be 18 years of age at the time of submitting your application. You must work in the Creative Industry.

2. Registration and Submission

Sign-Up Form: You must complete a sign-up form to be included in the Directory. The form requires accurate and complete information which includes information which will be displayed publicly:

·       Your name and the name of your enterprise

·       Your main creative discipline

·       Links to your website and social media

·       Description of your enterprise

·       Contact details you wish to be listed (you can opt not to list your email address publicly – we will still require your email address for the purpose of communication with you)

·       Photo of you or a graphic representing your enterprise (logo)

The sign-up form also requires mandatory information which will not be made public and is collected to manage the Directory and will be held securely, such as:

·       Address of your enterprise

·       Company registration (if you have one)

·       Email address for the purpose of communication between us and you (if you decide not to have your email listed)

Verification: The Culture Trust Luton reserves the right to verify the information provided and may contact you for further details if necessary.

3. Commencement Date

Your Membership shall commence on the date upon which your application is accepted by us.

4. Accuracy of Information

The information on the pages of this website has been prepared with reasonable care and is believed to be legal, honest, decent and truthful as of the date of its preparation.

The Culture Trust use our reasonable efforts to include accurate and up to date information on all pages of the Directory. Information is for guidance only and is not intended to form any part of a contract and can be subject to change without notice. The Culture Trust shall not be liable for any direct, indirect, incidental, consequential or cumulative losses or damages arising out of the use or inability to use these pages, any errors, misrepresentations or omissions on the material contained on them.

You are responsible for ensuring that all information provided is accurate, complete, and up-to-date. The Culture Trust are not responsible for any incorrect or misleading information provided.

5. Use of Information

Public Access: The information provided, including your photo, will be made publicly available on the Directory.

Privacy: Your contact information will be displayed as per your consent. We respect your privacy and will not share your personal data without your permission except as required by law.

6. Content and Conduct

Appropriate Content: You agree that the content you submit does not violate any laws, infringe on any third-party rights or contain any offensive, defamatory, or inappropriate material. You must hold copyright on any content submitted to the Directory.

Conduct: You agree to act professionally and respectfully in your communications and interactions with the Culture Trust and other users of the directory in line with the Culture Trust’s Visions and Values which can be found here:

The Culture Trust does not review all of the sites linked in the Directory and are not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by us of the site. Use of any such linked website is at the user’s own risk.

Without limiting any other provision in these Terms and Conditions, you may not use the Directory to do the following or assist others to do the following:

Threaten, defame, stalk, abuse, or harass other persons or engage in illegal activities;

Link to the Directory from a site or transmit any material that is inappropriate, profane, vulgar, offensive, false, disparaging, defamatory, obscene, illegal, sexually explicit, racist, that promotes violence, racial hatred, or terrorism, or that we deem, in our sole discretion, to be otherwise objectionable;

Violate any people or entity's legal rights (including, without limitation, intellectual property, privacy, and publicity rights), transmit material that violates or circumvents such rights, or remove or alter intellectual property or other legal notices;

Transmit files that contain viruses, spyware, adware, or other harmful code;

Advertise or promote goods or services without our permission (including, without limitation, by sending spam);

Interfere with others using the Directory or otherwise disrupt the Directory;

7. Intellectual Property

You retain all rights to your content, but by submitting it, you grant the Culture Trust a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content in connection with the Directory and related promotional activities.

8. Renewal

We will periodically contact you to renew your placement on the Directory. If no confirmation is made within 30 days of the initial contact, the Culture Trust reserve the right to remove your profile from the Directory. You can re-apply at any time.

9. Deletion and Termination

You can request deletion of your profile from the Directory at any time by notifying by email to HatDistrict@CultureTrust.com and your profile will be removed within 30 days of the notice. You can re-apply at any time.

The Culture Trust reserve the right to remove any information from the Directory at Trust’s discretion, without notice, for any reason, including but not limited to violation of these Terms and Conditions.

10. Disclaimer of Warranties

The Culture Trust provide the Directory "as is" and make no warranties, expressed or implied, regarding the accuracy, reliability, or availability of the Directory.

11. Limitation of Liability

In no event shall the Culture Trust be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use or inability to use the Directory.

12. Changes to Terms and Conditions

The Culture Trust reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on the www.HatDistrict.co.uk website, and continued use of the service constitutes acceptance of the modified terms.

The Culture Trust may occasionally change these Terms and Conditions, and you are encouraged to review the Terms and Conditions periodically. If you continue to use the Directory after the change the Terms and Conditions, you accept all changes.

13. Your Responsibilities

You shall:

Cooperate with the Culture Trust in relation to all matters relating to the Directory;

Comply with all applicable laws in relation to your use of the Directory;

You warrant and represent that you have the necessary consents and notices in place to enable the lawful transfer of all personal data that you do in fact disclose to us in accordance with all applicable data protection legislation, including the UK GDPR (meaning the General Data Protection Regulation (EU) 2016/679 as it forms part of the law of England and Wales, Scotland and Northern Ireland by virtue of section 3 of the European Union (Withdrawal) Act 2018) and the Data Protection Act 2018. 14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Marketing consent

The Culture Trust may be required by law to notify you of certain events. You hereby acknowledge and agree that such notices will be effective upon our posting them on our sites or delivering them to you via email. You may update your email address by emailing HatDistrict@CultureTrust.com. If you do not provide accurate information, the Culture Trust will not be responsible for failure to notify you. The Culture Trust’s failure to exercise or enforce any right or provision in these Terms and Conditions will not constitute a waiver of such right or provision.

The Culture Trust may use your data to contact you by email, phone and/or SMS with news and information about our products, services, events and activities that may be of interest to you.  The Culture Trust will not use your personal information for such purposes if you have told us that you do not wish to be contacted by not opting in to marketing permissions in the application form.
